Is your project 'public housing'? Pell Grants, dorms and shelters
A proposed CBC §202 rewrite would make a Pell-funded private dorm 'public housing' — and redraw who follows Chapter 11A vs 11B.
Here's the thing: before you can pick a sheet of accessibility rules, you first have to answer one question — is this project "public housing"? Get that wrong and you've reviewed the whole set against the wrong chapter.
A proposed rewrite of the California Building Code §202 definitions, filed by the Division of the State Architect as DSA-AC 01/25 in the 2025 Intervening Cycle, would move that line. Under it, a private college's dormitory would be "public housing" under the CBC if the school takes federal Pell Grants. These are proposed amendments — they went to the Building Standards Commission on August 25–27, 2026, and the definition changes are on the contested ("yellow") track. Treat them as a heads-up, not as code in force.
The definition decides the chapter
Residential accessibility in California splits two ways. Chapter 11A (HCD) covers newly constructed covered multifamily dwellings. Chapter 11B (DSA-AC) covers public accommodations and public housing. The §202 definition of PUBLIC HOUSING is the switch that sends a project to one or the other — so widening the definition widens Chapter 11B's reach. That's exactly what DSA-AC 01/25 does.
What the proposed definition adds
Three moves matter for scoping:
- It anchors "public housing" to the state "covered entity"/"state support" regulations — CCR Title 2, §§14000 and 14020 — alongside the federal 28 CFR 35.102(a) already cited.
- It adds a new defined term, EDUCATIONAL ENTITY IN RECEIPT OF FINANCIAL ASSISTANCE: a college, university, K-12 or career-technical school, or a private education business, "any part of which is a covered entity that is a recipient of state support or federal financial assistance." Housing run by such an entity becomes public housing — private colleges included.
- It strikes transient lodging (hotels, motels, hostels) from the public-housing list and adds employer-provided housing for an employee … such as fire station dormitories.
Verified against the DSA-AC 01/25 Express Terms: the new education term reaches any covered entity receiving aid "including, but not limited to, federal Pell Grants or work-study programs." That example is the code text's own — it doesn't reach past what the text names.
One more: place of public accommodation, item 10, now expressly includes "housing facilities provided for students or employees."
Where it lands in Chapter 11B
The scoping sections move, too. 11B-224 is retitled, and the two California sub-sections relocate: housing at a place of education → new 11B-233.4, and group homes, halfway houses and shelters (social service center establishments) → new 11B-233.5.
The split inside those sections is the part to read closely. Housing or a shelter that is public housing must comply with both 11B-233.2 (the federal Section 504 / HUD layer) and 11B-233.3. Everything else — for example, education housing run by an entity not in receipt of financial assistance — complies with 11B-233.3 only.
The HCD coordination fix
Separately, HCD 1-AC 01/25 does housekeeping, and it's uncontested (the "green" matrix). It repeals HCD's duplicate PUBLIC HOUSING definition, leaving the DSA-AC version to stand alone, and it deletes the stray "Chapter 11A and" from the administrative sentence in §1.8.2.1.2 (Parts 2, 4 and 5) and §89.108.2.1.2 (Part 3).
Don't oversell this one. §1101A.1 already reads "Chapter 11B" only for a covered multifamily dwelling that is also public housing. The edit just makes the two sentences agree — a coordination fix, not new law.
What didn't change
Two guardrails, because leaving a claim out is safer than overreaching:
- The Note after the definition was not amended — DSA-AC withdrew those edits. So density bonus alone is still not a "public entity's program to provide housing," and the Note still points you to DSA's "Guide to Public Housing Regulated in Chapter 11B of the California Building Code."
- A separate proposed standalone definition of "Social Service Center Establishment" was withdrawn. There is no new §202 definition for it.
And the headline "state support" language drew a formal objection from the Industry Coalition/CBIA — which called it vague and ambiguous — while CALBO opposed the broader package. These are proposed, not adopted.
What to do at intake
Document two things before you commit to 11A or 11B: the funding sources and the operator — a public-entity program, state support, or a Pell-receiving school. Whether a specific institution is a "covered entity" is a legal call keyed to CCR Title 2 §14020; read it, use DSA's Guide, and verify with your local jurisdiction rather than deciding it on the fly.
What CrossBeam does with it
CrossBeam flags, at intake, when a residential project's funding or operator could pull it into Chapter 11B's public-housing scope — so the 11A-versus-11B call gets made before the review runs, not after a correction letter. When a change like this is still proposed and contested, we say so, so you can plan without betting on the outcome.
